ウミリデノブ　アリシェル氏

名古屋経済大学ビジネス法学部・准教授

　横溝先生の抵触法ラボの皆さん、こんにちは。このラボの初めての卒業生のウミリデノブ　アリシェルです。2017年4月から愛知県の犬山市にある名古屋経済大学で国際経済法と国際取引法を教えています。

　中央アジアのウズベキスタン共和国出身の私は、2008年12月に東京で行われた「大学対抗交渉コンペテイション」の際に初めて横溝先生とお会いできました。実は、私の元々の専門は、国際公法ですが、抵触法との共通問題も少なくなく、 この自分も知らないうちに横溝先生のラボに入っていきました。中でも横溝先生の「租税法規範の国際的な抵触とその調整」という科研は、私の研究テーマとも重なる部分があり、先生のお世話になりました。

　自分の経験から申し上げますと、博士課程（前期・後期）というのは、なかなか大変です。将来が明確に見えない、研究が終わらない、先生の納得を得られない、国内・海外報告が絶えない…。これらは絶対に横溝先生の抵触法ラボの本格的なメンバーになりたい学生が必ず直面することです。心の準備が必要になります。それにもかかわらず、自分が好きな研究テーマを選び、横溝先生のアドバイスを「偏らないで」・「時間通りに」やっていくと、きっと研究結果が蓄積され、将来も見えてくることでしょう。

　犬山市には遊園地がたくさんあります。遊びに来た時には、名古屋経済大学での私の研究室にもぜひ寄ってください。ウズベキスタンの美味しいドライフルーツを差し上げます。

　ホームページをご覧の皆様、はじめまして。横溝先生のご指導の下で、修士号及び博士号を取得した後、2018年4月に広島大学大学院社会科学研究科に准教授（国際私法）として着任しました、加藤紫帆と申します。

　私は、グローバルな経済・社会の適切な規整という観点から、現代国際社会において生じる具体的な事例（例えば、文化財の不正取引）に対する抵触法上の解決を再検討することを通じて、伝統的な抵触法理論・方法の再評価・再構築を図ることを目標に、研究を行っています。研究者としてはまだまだ未熟者ですが、広島（正確には、「東広島市」というところです）という新たな地で、研究・教育活動に一層精進していきたいと思っています。

　横溝先生、あるいは抵触法との出会いは、名古屋大学の学部1年生の時に参加した「基礎セミナー」（自由や民主主義に関する古典的文献を講読するもの）の場でした。当時は、国際結婚や国際契約といった、抵触法が対象とする私法的な法律関係には全く興味関心がわきませんでした（横溝先生の「情熱」は全く理解できなかったわけです）。その後、ひょんなことから横溝先生の学部ゼミに参加することとなり、また先生による抵触法の講義を受ける中で、抵触法が国際ビジネスにおいて実務的な重要性を有しているだけでなく、実は「法」とは何かを考えさせる法哲学的な側面を有していること等、とりわけその深遠さに興味を惹かれ、研究の途を志しました。

　抵触法は、民事法分野だけでなく、国際法や租税法、経済法といった公法・社会法分野、比較法や法哲学、法社会学といった基礎法分野、さらには、国際政治といった政治学分野とも、関連性を持つ法分野であり、実に様々な観点・関心から勉強することができる興味深い法分野だと思います。皆様も抵触法に少しでも関心を持って下さると、抵触法を研究する者として大変嬉しく思います。

Hello,

My name is MEN Vuthyka. I am from Cambodia. I was a master and doctoral student at Nagoya University. My research concerns issues in international commercial arbitration. Professor Yokomizo was my main academic advisor during my master and doctoral study.

I was blessed to have become a student of professor Yokomizo. When I first arrived in Japan in 2013 as a master student, my research and writing skills were limited. I also had little knowledge about private international law. Throughout my study at Nagoya University, I was able to obtain substantive knowledge about international commercial arbitration and private international law, including those of Japan as well as America and the EU through attending professor Yokomizo’s seminars. Furthermore, professor Yokomizo often organized reading sessions with his students, including me, so that we could further discuss about various articles concerning international arbitration and/or private international law. From the discussions in the seminars and reading sessions, I was able to advance my knowledge, research and writing skills. My skills also improved through the process of writing my master and doctoral theses. From one draft to another, I received many helpful remarks and advices from professor Yokomizo on how to improve my theses. For these, I am very grateful to have been under his supervision.

Finally, what I have realized from my study is that private international law is a very important subject. Every cross-border transactions and private activities require a consideration about certain aspects of private international law. As the society evolves, the laws also need to update. For this reason, I hope that there will be more and more students who are interested in researching in the field of private international law. 

福田　竣介氏

ノートルダム大学ロースクール（ジュリス・ドクター課程）

　横溝先生のホームページをご覧の皆様、はじめまして。横溝ゼミ卒業生の福田竣介です。２０１８年に名古屋大学法学部を卒業し、現在はアメリカのインディアナ州にあるノートルダム大学ロースクールのジュリス・ドクター（JD）生です。

　私は、「模擬国際仲裁大会」に参加した際、横溝先生と出会い、その流れで横溝ゼミを履修することになりました。国際私法に関して右も左も分からない私でしたが、横溝先生のご指導のお陰で、この分野の重要性を感じ、専門性を高めようと決意しました。

　私がゼミで感じたことは、実務の世界でも変わることはありませんでした。学部卒業後、私は某外資系法律事務所でインターン生として働きました。クライアントから様々な国際的なマターを取り扱いましたが、そのほとんどのケースで国際私法が関係していました。しかし、国際私法は司法試験では選択科目に過ぎない上、ロースクールの必須科目でないため、この分野に精通する現役弁護士は少ないようです。そのため、この分野が得意な弁護士は、これからの法曹界で重宝されると身を以て感じました。

　グローバル化やインターネットの普及が進む今、個人や企業は一つの管轄や国を超える法律問題に直面する機会が増加しています。しかし、みなさんご存知の通り、法律は全世界で統一されていません。抵触法や裁判管轄の決め方等、国際的な法律問題は複雑さを極めています。この国際私法という分野は、それらの問題を解決する、非常に便利なツールです。国際交流が進むと予想される今、国際私法の需要と重要性は日に日に増すでしょう。

　確かに、国際私法を理解するには多少時間が掛かるかもしれません。しかし、この分野無くして、今日の法曹界やビジネス界は成り立ちません。是非、この機会に皆さんも国際私法にご興味を持っていただけたら、幸いに存じます。

Hello, Members of Professor Yokomizo Law-Lab.

I am WANG Fayang, from Mainland of China. I was enrolled in Nagoya University Graduate School of Law on October 2014. Professor Yokomizo was not only my academic mentor, but also a coordinator professor in Leading Program I was affiliated with. Under Professor’s supervision, I successfully obtained my master and doctoral degree in 2016 and 2019.

I first attended Professor’s course, Comparative Study of Law. This course was very helpful for me to obtain the necessary knowledge and skills on comparative legal research. Those knowledge and skills were well applied to my Joint Research in Leading Program, my master and doctoral research. So far, I still benefit a lot from them.

Pursuing a doctor degree for me was difficult. Without Professor’s meticulous guidance, I would not have accomplished it. Professor always gave me very helpful and inspiring suggestions throughout my whole study in Japan. His invaluable supervision and encouragement enabled me to overcome challenges during this difficult journey of academic pursuit.

Hope you have a wonderful time in Professor’s Lab, and fulfill your academic aspirations in the future.

Dr. Rizoev Muso

My name is Muso. I am from Uzbekistan. My research interests are International investment law, arbitration, and good governance. I was a master’s and doctoral student of Nagoya University under the supervision of Professor Dai Yokomizo.

In 2013, when I enrolled as a Master’s student at Nagoya University, my research topic concerned commercial arbitration area. However, while doing a literature review on arbitration, I became more interested in investment arbitration and decided to change my research direction. Although Professor Yokomizo had agreed to be my supervisor based on my research proposal on the topic of commercial arbitration initially, he considered my interest and inclination and supported me in my decision. Moreover, for gaining both master’s and doctor’s degrees, I spent more time than usual due to COVID and personal circumstances. However, Professor Yokomizo was patient and kept supporting me in my studies. When I could not go to Japan, he kindly supervised my thesis writing process online.

Professor Yokomizo is always available for his students. He finds time to discuss not only academic matters but also the personal issues of his students. I do not remember the time when I have not got a response to my email or request. He was always observant and never hesitated to provide his valuable and constructive feedback. Thanks to him, I was always motivated to study and learn more.

Last but not least, I had an opportunity to gain substantive knowledge in the law discipline through attending Professor Yokomizo’s classes, guest lectures, and study groups organized by him. In addition to classes, study groups were extremely effective where we used to discuss books and academic articles concerning our research direction.

Professor Yokomizo possesses not only outstanding intellectual abilities but also has very good personal qualities. He is very kind, open-minded, and communicable person. He has very friendly relationships with all his students at the university. Among colleagues and students, he is a well-respected person from whom they can ask for advice and help when needed.

Dr. Apipong Sarntikasem　
（アピポン　サーンティカセーム氏）

タイ王国司法裁判所判事

　はじめまして。タイ王国司法裁判所判事のアピポン　サーンティカセームと申します。現在、タイ王国最高裁判所事務総局で最高裁長官を補佐し、司法行政・司法制度改革・立法等を担当しています。名古屋大学で博士号を取得するまでは、タイ各地の地方裁判所で民事・刑事・家事事件の審理を担当しました。

　横溝先生のご指導の下で研究するきっかけとなったのは、タイの国際民事訴訟制度の改正を任せられたことでした。タイのモデルとして日本の新しい国際裁判管轄法制を調査したときに、法制審議会の議事録や様々な論文を読み、横溝先生に出会いました。そこで、先生の理論や国際私法の奥深さに感銘を受け、もっと深く研究したいと思うようになりました。

　博士課程での研究は、決して容易ではありませんでしたが、博士論文の執筆の他に、横溝ゼミのTAや学会等での報告の機会を与えられ、とても充実した日々でした。また、横溝先生は、非常に親切なお方で、ご指導も丁寧でした。先生は、私の研究成果や意見を評価してくださるとともに、鋭い指摘をしてくださいました。また、私が客員研究員として海外に行った時も温かくサポートしてくださいました。横溝ゼミは多様なバックグラウンドや国籍を持つ学生が集まっており、日本の事のみならず、世界各国の法制度についても学ぶことができるユニークなゼミでした。また、自由度が高いため、自分の関心に沿って研究することが出来ました。ホームページをご覧の皆様、もし国際私法に興味を持って下さるなら、ぜひ横溝先生の抵触法研究室をご検討くだい。

Dr. HAILU Gebru Gebrehiwot

Greetings,

My name is HAILU Gebru Gebrehiwot and I am from Ethiopia. I earned my master's degree in Private International Law (PIL) and my Ph.D. in International Commercial Arbitration Law (ICA) under the guidance of Professor Dai YOKOMIZO. I consider myself incredibly fortunate to have had the opportunity to study under his supervision during my time as an international student in Japan. At the outset of my studies, I possessed limited research and writing skills, along with a limited understanding of PIL and ICA laws. However, by attending Professor YOKOMIZO’s seminars on both subjects, I was able to deepen my theoretical grasp on both ears of studies.

On top of organizing seminars, Professor YOKOMIZO regularly arranges one-on-one consulting sessions with his students, including myself, to discuss our progress in writing our thesis and provide valuable feedback. Through these face-to-face meetings and ongoing supervision, I was able to significantly enhance my theoretical knowledge of PIL and ICA law. Furthermore, Professor YOKOMIZO’s unwavering support aided in the development of my rigorous logical thinking, case analysis, and research writing skills. I am truly grateful to have had him as my main mentor.

I should also mention an additional fact that affected my academic journey—it took me longer than anticipated to earn my Ph.D. degree due to unforeseeable roadblocks. A conflict in my home country resulted in a communication blackout that prevented me from contacting my parents for over two years. The COVID-19 pandemic added to these challenges, along with some personal struggles. At one point, I almost gave up on my research because I felt disheartened. Fortunately, Professor YOKOMIZO exceeded my expectations by not only discussing academic subject but also providing guidance on personal issues during those challenging times. Thanks to his unwavering support, I regained my research motivation and successfully pursued my objective.

In conclusion, throughout my academic journey, I have come to realize the paramount importance of conducting a thorough and continues research on the fields of PIL and ICA. The COVID-19 pandemic has brought to light both the advantages and disadvantages of globalization that I could not discuss here in detail due to space limit. One issue that the pandemic underscored is that how economically interdependent the world is and how traditional physical borders are becoming less significant. We can no longer rely solely on stringent border policies, robust national economic policy and national laws to address transnational issues. Instead, we must seek a system that reduces conflicting rules and promotes harmonization. In my view, conducting a comprehensive comparative study of PIL and ICA laws can help us discover practical solutions for transnational economic and private challenges. I hope that more students will be inspired to research on those fields in the future. 

Dr. Nguyen Quang Anh

My name is Nguyen Quang Anh. I studied at the Graduate School of Law, Nagoya University—first as a Master’s student from 2016 to 2018 and later as a PhD candidate from 2022 to 2025. On both occasions, I have been fortunate to conduct my research under the supervision of Professor Dai Yokomizo.

His guidance has profoundly shaped my academic development. Through regular PhD meetings, reading sessions, and his thoughtful questions and feedback, he helped me deepen my understanding and refine my dissertation.

Beyond academics, I was deeply moved by Professor Yokomizo’s care and support for the personal well-being of his students. Although he always appears calm and formal, his kindness is unmistakable. I will never forget his efforts to support my family’s life in Japan. Without his help, my PhD journey would have been far more difficult.

I am deeply grateful to Professor Yokomizo for his exceptional mentorship. It has been a great honor and privilege to be one of his students, and I look forward to continuing to learn from his wisdom as I advance my academic career.

Dr. KHAKIMOV Akhadjon

　ホームページをご覧の皆様、はじめまして。

　横溝先生のご指導の下で修士号および博士号を取得いたしました、ハキモフ　アハドジョンと申します。ウズベキスタン出身です。

　私は2015年にウズベキスタンにおける名古屋大学の日本法教育研究センターを経由し、名古屋大学の修士課程に入学いたしました。2017年に修士号を取得した後、自国での法科大学に勤務いたしましたが、その間も横溝先生のご指導を賜り、研究を継続することができました。

　2022年には再び名古屋大学博士課程に戻り、横溝先生のご指導のもと、伝統的な抵触法理論・方法の再評価に取り組みました。特に、非国家法（イスラーム金融におけるシャリーア法や国際基準など）の準拠法適格性に焦点を当てて研究を進めてまいりました。順調に歩んでいたキャリアを中断し、社会人から学生へと戻ることは容易ではありませんでしたが、国際私法のゼミを通じて、国際私法の哲学的基礎からグローバル・ガバナンスに至るまで幅広く学ぶことができ、また、横溝先生からは法律研究にとどまらず、人間性や礼儀、倫理といった日常生活や専門的活動に不可欠な価値についても多くを習い、かけがえのない知識と経験を得ることができたと確信しております。

　国際私法は法学のなかでも哲学的な難しさを伴う分野であると感じていますが、今後、国民や企業が国境を容易に越え、現実の場やインターネット上で接触し、また国内においても多様な共同体が隣り合って暮らす世界において、兄弟である私たち人類が互いとの法律関係を倫理的に解決する有益な法分野として、その学びが社会や実務に貢献できると信じております。

　今後も互いに学び合いながら、共に知識を広げていきましょう。
